Burnaby WorkHub Terms & Conditions

The services provided by Burnaby WorkHub are subject to the following Terms and Conditions (“T&C”). Burnaby WorkHub reserves the right to update these Terms and Conditions at any time without prior notice.

Membership at Burnaby WorkHub does not create a tenancy agreement or lease. Membership constitutes a prepaid, revocable license to use the provided amenities and services on a monthly, daily, or casual basis.

1. Description of Services

Burnaby WorkHub may provide Members with access to coworking space, private offices, dedicated desks, hot desks, internet access, meeting rooms, office equipment, printing services, virtual office services, lounge areas, classroom/event spaces, mail handling services, and other related services (collectively, the “Services”).

All Services are provided subject to these Terms and Conditions.

2. No Unlawful or Prohibited Use

You agree not to use the Services for any unlawful or prohibited purpose.

You may not use the Services in any manner that could:

• damage, disable, overburden, or impair Burnaby WorkHub systems or network;
• interfere with another member’s use and enjoyment of the Services;
• violate any applicable municipal, provincial, federal, or international law.

You may not:

• attempt unauthorized access to systems, accounts, or networks;
• engage in hacking, password mining, or data harvesting;
• upload malicious software, viruses, or harmful files;
• use the Services to distribute spam, fraudulent, misleading, or illegal content.

You represent and warrant that you have the legal authority to enter into this Agreement.

3. Use of Services

Members agree not to:

• engage in harassment, threats, abusive conduct, or discrimination;
• create excessive noise or disruptions;
• conduct illegal business activities;
• damage Burnaby WorkHub property;
• misuse internet, technology, or meeting room systems;
• create unsafe or hazardous conditions.

Burnaby WorkHub reserves the right to refuse service or remove any individual who violates these Terms or disrupts the coworking environment.

4. Access & Security

Members are responsible for:

• keeping access cards, FOBs, passwords, and entry credentials secure;
• ensuring doors are not left open or unsecured;
• preventing unauthorized individuals from entering the premises.

Lost or unreturned access devices may result in replacement charges.

Burnaby WorkHub reserves the right to deactivate access credentials immediately upon termination, non-payment, misuse, or security concerns.

5. Guest Policy

Guests are permitted only in private office areas and subject to approval by Burnaby WorkHub.

Members are fully responsible for:

• their guests’ conduct;
• damages caused by guests;
• ensuring guests comply with these Terms and Conditions.

Burnaby WorkHub may limit, deny, or revoke guest access at its sole discretion.

6. Meeting Rooms & Shared Spaces

Meeting rooms, classrooms, media rooms, and shared amenities must be used respectfully and left clean after use.

Members may be charged additional fees for:

• overtime usage;
• damages;
• excessive cleaning;
• unauthorized occupancy.

Bookings are subject to availability.

7. Virtual Office & Mail Services

Virtual office services may include:

• business address usage;
• mail receiving and handling;
• meeting room access;
• coworking access (depending on membership level).

Members agree:

• the address may not be used for illegal or misleading purposes;
• Burnaby WorkHub is not responsible for lost, delayed, or returned mail;
• unclaimed mail may be discarded or returned after a reasonable holding period;
• virtual office services do not establish tenancy or occupancy rights.

Members remain solely responsible for:

• licensing requirements;
• banking compliance;
• CRA correspondence;
• legal or regulatory obligations.

8. Internet & Technology Disclaimer

Internet, Wi-Fi, printing, phones, and related technology services are provided on an “as available” basis.

Burnaby WorkHub does not guarantee uninterrupted or error-free service and is not liable for:

• internet outages;
• technology failures;
• cybersecurity incidents;
• loss of data;
• business interruption.

Members are responsible for securing their own devices and information.

9. Renewals & Terminations

Memberships automatically renew monthly unless cancelled in writing.

Members must provide at least:

• 30 days written notice for termination of month-to-month memberships;
• any longer notice period specified in a separate office agreement.

Failure to provide proper notice may result in charges for the following billing cycle.

Burnaby WorkHub reserves the right to terminate memberships immediately for:

• non-payment;
• policy violations;
• illegal conduct;
• harassment or disruptive behavior;
• misuse of the premises.

Unused prepaid fees may be refunded on a prorated basis at Burnaby WorkHub’s discretion after deducting outstanding charges.

10. Invoicing & Payment

Membership fees are invoiced monthly in advance.

Payment is due on the invoice due date.

Additional charges may apply for:

• meeting room usage;
• printing;
• mail services;
• late payments;
• damages;
• lost access devices.

Membership fees are non-refundable unless otherwise stated in writing.

Late or unpaid balances may result in:

• suspension of Services;
• denied facility access;
• termination of membership;
• collections activity.

11. Confidentiality

Members acknowledge they may be exposed to confidential or proprietary information belonging to Burnaby WorkHub or other members.

Members agree to:

• maintain confidentiality;
• not disclose confidential information to third parties;
• not misuse confidential information.

All confidential information remains the property of its respective owner.

12. Participation at Own Risk

Participation in and use of the Services is entirely at your own risk.

Burnaby WorkHub is not responsible for:

• personal injury;
• theft;
• lost or damaged property;
• business interruption;
• lost profits;
• data loss.

Members are responsible for securing their own belongings.

13. Insurance

Burnaby WorkHub maintains general liability insurance for its operations.

Members are strongly encouraged to maintain their own insurance coverage, including:

• business insurance;
• renters insurance;
• property insurance;
• liability insurance.

Burnaby WorkHub is not responsible for damage to Member-owned equipment or property.

14. CCTV & Security Monitoring

For safety and security purposes, Burnaby WorkHub may utilize video surveillance in common areas.

By using the Services, Members consent to such monitoring where permitted by applicable law.

15. Emergency Closures & Force Majeure

Burnaby WorkHub shall not be liable for interruptions, delays, or inability to provide Services caused by:

• emergencies;
• utility failures;
• internet outages;
• weather events;
• natural disasters;
• government orders;
• landlord restrictions;
• maintenance issues;
• events beyond reasonable control.

16. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied.

Burnaby WorkHub disclaims all warranties including:

• merchantability;
• fitness for a particular purpose;
• uninterrupted availability;
• accuracy or reliability of Services.

17. Limitation of Liability

To the maximum extent permitted by law, Burnaby WorkHub’s total liability arising from or related to the Services shall not exceed the total membership fees paid by the Member during the one (1) month immediately preceding the event giving rise to the claim.

Burnaby WorkHub shall not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits or business opportunities.

18. Non-Disparagement

Members agree not to make false, defamatory, or malicious statements regarding Burnaby WorkHub, its staff, members, services, or operations.

Nothing in this clause limits lawful reviews or legally protected speech.

19. Indemnification

Members agree to indemnify and hold harmless Burnaby WorkHub, its owners, employees, contractors, affiliates, and agents from claims, damages, liabilities, costs, and expenses arising from:

• Member conduct;
• violation of these Terms;
• damage caused by the Member or their guests;
• illegal activity;
• negligence or misconduct.

20. Severability

If any provision of these Terms is determined invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21. Governing Law

These Terms and Conditions shall be governed by the laws of the Province of British Columbia and the applicable laws of Canada.

Burnaby WorkHub Policies

22. Smoking Policy

Burnaby WorkHub is committed to maintaining a clean, healthy, and professional environment for all Members, guests, and visitors.

Smoking, vaping, cannabis use, and the use of tobacco-related products are strictly prohibited inside:

• coworking areas;
• private offices;
• meeting rooms;
• washrooms;
• hallways and common areas;
• entrances and exits;
• any indoor area operated by Burnaby WorkHub.

Burnaby WorkHub does not provide a designated smoking area unless otherwise permitted by building management.

All Members and guests must comply with applicable municipal, provincial, and building regulations regarding smoking and vaping.

Failure to comply with this policy may result in warnings, fines, suspension of access privileges, or termination of membership.

23. Internet, Network & Email Usage Policy

The internet, Wi-Fi, network infrastructure, and communication systems provided by Burnaby WorkHub are intended for lawful, professional, and business-related use.

Members are expected to use all technology services responsibly and professionally.

Security & Confidentiality

Security and confidentiality are important responsibilities shared by all Members using Burnaby WorkHub Services.

Members are responsible for:

• securing their own devices, passwords, and login credentials;
• maintaining appropriate cybersecurity protections on their equipment;
• protecting confidential business and client information;
• ensuring downloaded files and software are safe and properly licensed.

Burnaby WorkHub reserves the right to monitor, inspect, restrict, suspend, or terminate access to its internet and network systems where reasonably necessary to:

• protect network security;
• investigate misuse;
• comply with legal obligations;
• enforce Burnaby WorkHub policies.

Acceptable Use

Members may not use Burnaby WorkHub systems or internet services to:

• engage in illegal activity;
• transmit or access offensive, discriminatory, obscene, pornographic, violent, or harassing material;
• conduct fraudulent or deceptive activities;
• distribute spam or unsolicited communications;
• infringe copyright, trademark, or intellectual property rights;
• introduce viruses, malware, ransomware, worms, or harmful software;
• attempt unauthorized access to systems, accounts, or data.

Any misuse of Burnaby WorkHub technology systems may result in suspension or termination of Services.

Software & Downloads

Software downloads and installations must be:

• legally licensed;
• business-related;
• compliant with applicable laws and licensing requirements.

Members are responsible for scanning downloaded files and maintaining appropriate antivirus protection.

Burnaby WorkHub is not responsible for:

• cybersecurity breaches;
• software incompatibility;
• device damage;
• loss of data;
• internet interruptions or outages.

Community Conduct Policy

Burnaby WorkHub is committed to fostering a respectful, collaborative, and professional coworking environment.

All Members, guests, and visitors are expected to:

• act professionally and respectfully;
• maintain reasonable noise levels;
• respect shared spaces and equipment;
• avoid disruptive, threatening, discriminatory, or harassing behavior;
• comply with all Burnaby WorkHub policies and applicable laws.

Enforcement

Burnaby WorkHub reserves the right to address policy violations through:

• verbal or written warnings;
• suspension of access privileges;
• restriction of facility access;
• immediate termination of membership where warranted.

Burnaby WorkHub may investigate complaints involving:

• harassment;
• discrimination;
• threats or violence;
• illegal activities;
• property damage;
• repeated policy violations.

Members are expected to cooperate with reasonable investigations related to safety, security, or operational concerns.

Burnaby WorkHub reserves the right to take immediate action where conduct negatively impacts the safety, operations, reputation, or community environment of the workspace.
